Thriving Communities - Employability Service Case Studies Privacy Notice

South Ayrshire Council's, Thriving Communities, Employability Service provides a range of programmes designed to support young people and adults into employment.  Where you agree to take part in a case study relevant to your experiences on these programmes we will require to collect some personal information from you.

As the 'data controller' for the personal information - or data - we hold about you, South Ayrshire Council decides how your personal information is used/processed, and what it is used for.

Your personal data - what is it?

Personal data is information relating to a living person who can be identified from that data. Identification can be based on the information alone, or in conjunction with any other information. The processing of personal data is governed by the UK General Data Protection Regulation (UK GDPR) and supplemented by the Data Protection Act 2018.

What Personal Data will we collect from you?

The Employability Team provides a range of programmes and to recognise your support and achievements, we would like to publish case studies relevant to your experiences on these programmes.  The personal data we may collect is:

• Photographic images
• Personal experiences from the programme
• Video images

How will we use your information?

The data will be used to recognise your support and achievements throughout the programme by the publication of a Case Study.  Your photographic/video images and your personal information published within your Case Study will only be used for the purposes explained in the Case Study/Photograph Agreement Form. Your agreement will be sought before any images are taken or personal experience information is used. We will also share your case study or press release with you before we start to use it for public activity.

What is the legal basis for using/sharing your information?

Our legal basis for processing your personal data is you have freely given your consent to the processing of your personal data for the specific purposes as described in the completed agreement form.  You can withdraw your consent in whole or in part at any time.  If you wish to withdraw your consent, please let us know by contacting ThrivingCommunitiesAdmin@south-ayrshire.gov.uk.   Please note once information has been shared it cannot be unshared.  For example, if you have agreed that we can use your image(s) in our Case Study and we have published this on our social media sites, we cannot retract that use. We can however ensure we no longer use your image(s) in the future, should you choose to withdraw consent.

Who will we share your information with?

Where we receive your agreement to publicise a Case Study relevant to your support/achievements, this information will be used for Council purposes e.g. in magazines, newspapers, leaflets, displayed on our Council website and social media sites e.g. Facebook, Twitter and Instagram, it may be discussed on a radio station or on television and may be provided to partner organisations, e.g. Skills Development Scotland, Department of Work and Pensions, depending on your level of agreement.

How long do we keep hold of your information?

We will keep your personal data for no longer than reasonably necessary.  Your information will be retained in line with our Corporate Records Retention Schedule as follows:

What are your rights?

The lawful basis for processing/using your personal data directly impacts which rights are available to you.

You can ask us to:

• correct your personal information if it is inaccurate;
• complete your personal information if it is incomplete;
• restrict the processing of your personal information in certain circumstances; and
• erase your personal information in certain circumstances.

You also have the right to object to the processing of your personal information.

What are the consequences of failing to provide personal information?

Failure to provide the personal information requested will mean that we will not be able to publish a Case Study relevant to your experiences when taking part in one of our programmes.
