Kiosk No.2, Esplanade, Ayr Common Good Consultation
Notice of consultation under Section 104 of the Community Empowerment (Scotland) Act 2015
Reason for Site Notice Being Displayed: South Ayrshire Council is proposing to lease Kiosk No.2, Esplanade, Ayr - shown outlined in red on the plan below - to a local business. The business intends to redevelop the kiosk site to improve the available facilities and continue its current use to sell food, drinks and fancy goods.
The proposed new lease is to the existing tenant and will allow year-round operation of the kiosk.
Notice is hereby given of a PUBLIC CONSULTATION.
In terms of Section 104 of the Community Empowerment (Scotland) Act 2015 (the Act), local authorities are required to consult with the local community when planning to dispose of common good property or change its use. Under the Act, a disposal includes a proposal for long-term lease.
The proposal is for Kiosk No.2, located on Esplanade, Ayr to be leased to a local business for a term of 25 years. The tenant will invest in the demolition of the existing structure and the building of a new café and kiosk on the same footprint to include indoor eating facilities, allowing year-round operation of the kiosk.
The proposed rent has been assessed by an independent Chartered Surveyor and found to be comparable with similar properties, reflective of market value and, therefore, offering Best Value.
It is anticipated that the proposal will yield the following benefits:
- Economic Development - the proposal is expected to benefit the visitor economy, attracting visitors and associated spend to the local area, contributing to South Ayrshire Council Tourism & Events Strategy.
- Regeneration - by improving the look and available facilities of a highly visible property, contributing to Priority One: Spaces & Places of the South Ayrshire Council Plan 2023-28.
- Ayr Common Good fund will benefit from the receipt of an annual rent over a period of 25 years.

Description of the Consultation Process
Anyone may make representations about this proposal to South Ayrshire Council. Representations must be in writing, by email, or by online response as detailed below and include the name and address of the person making it. All representations must be received by 16:00hrs on Friday 16th May 2025. All representations received will be published with the exception of those considered to be potentially offensive or libellous. The names of individuals and organisations making representations and their postcode will be published alongside the representation made. The Council will remove any telephone numbers, mobile numbers, personal email addresses, residential addresses and signatures from published information.
