Education Services Privacy Notice(Appeals) - Sub-Committee and Local Attendance Council Volunteers

When you apply to be a volunteer member to sit on the Educational Services (Appeals) Sub-Committee (commonly referred to as the Education Appeals Panel) and the Local Attendance Council we may need you to provide us with some personal information.

As the 'data controller' for the personal information - or data - we hold about you, South Ayrshire Council decides how your personal information is used/processed, and what it is used for.  This statement provides more details about this and provides information on how to get in touch with us if you need to know more.

Your personal data - what is it?

Personal data is information relating to a living person who can be identified from that data. Identification can be based on the information alone, or in conjunction with any other information. The processing of personal data is governed by the UK General Data Protection Regulation (UK GDPR) and supplemented by the Data Protection Act 2018.

What Personal Data will we collect from you?

To enable you to be considered as a volunteer on the Education Appeals Panel and the Local Attendance Council, we will need to collect some personal information from you.  We need this personal data to allow us to contact you regarding the volunteer recruitment process and, where appointed, your involvement with the Appeals Panel and Local Attendance Council.  The personal data we will routinely collect is as follows:

PleaseNote:  Before providing referees contact details, it is your responsibility to ensure that you have notified the referees and obtained their agreement for us to contact them.

How will we use your information?

The personal data you provide to us will be processed by staff within the Council's Legal, Democratic and Educational Services.  We will only collect your data in order to:

·         assess your suitability for the voluntary position;

·         process your application;

·         complete relevant and required recruitment appointment checks; and

·         where appointed, enable payment of travel expenses (where relevant).    

What is the legal basis for using/sharing your information?

Processing is necessary under the terms of the UK GDPR for the performance of a task carried out in the public interest, as per Article 6(1) (e) of the UK GDPR, and the task or function has a clear basis in law. The main law underpinning the provision of the voluntary role for the Education Appeals Panel and Local Attendance Council is the Education (Scotland) Act 1980.

Who will we share your information with?

To enable us to recruit you as a volunteer member, we may require to share your information with the following:

·         Disclosure Scotland

·         Referees (provided by you)

How long do we keep hold of your information?

We keep your personal data no longer than reasonably necessary.  Your information will be retained in line with our Corporate Records Retention Schedule as follows:

What are your rights?

The lawful basis for processing/using your personal data directly impacts which rights are available to you. For example, some rights will not apply, where we are processing your data under public task (Article 6 (1) (e)) we are not required to:

·         erase your personal information

·         enable the right to data portability

However, you do have the following rights and can ask us to:

·         correct your personal information if it is inaccurate;

·         complete your personal information if it is incomplete;

·         restrict the processing of your personal information in certain circumstances

You also have the right to object to the processing of your personal information and the right to access your personal information.

What are the consequences of failing to provide personal information?

If you fail to provide the personal information we require we will be unable to process your application to be considered as a voluntary member of the Education Appeals Panel and Local Attendance Council.

What about Automated Decision- Making?

Our service does not use automatic decision making.
